Article 34: Family residence permit

Part Two: Foreigners › Chapter Two: Residence

(1) A family residence permit may be granted, for periods not exceeding three years at a time, to the following persons of Turkish citizens, of persons falling within the scope of Article 28 of Law No. 5901, or of foreigners holding one of the residence permits, as well as of refugees and holders of subsidiary protection status:

a) Foreign spouse,

b) His or her own or his or her spouse's minor foreign child,

c) His or her own or his or her spouse's dependent foreign child,

However, the duration of the family residence permit may in no case exceed the duration of the sponsor's residence permit.

(2) In the case of marriage to more than one spouse under the law of the country of which the person is a citizen, a family residence permit shall be granted to only one of the spouses. However, a family residence permit may also be granted to the children from the other spouses.

(3) For the family residence permit of children, the consent of the mother or father who shares joint custody, if residing outside Türkiye, shall be required.

(4) Family residence permits confer the right to education in primary and secondary education institutions until the age of eighteen without obtaining a student residence permit.

(5) Those who have stayed in Türkiye with a family residence permit for at least three years and have reached the age of eighteen may, upon request, convert this permit into a short-term residence permit.

(6) In the event of divorce, a short-term residence permit may be granted to a foreigner married to a Turkish citizen, provided that he or she has stayed with a family residence permit for at least three years. However, if it is established by a relevant court decision that the foreign spouse has been a victim on grounds of domestic violence, the three-year period requirement shall not apply.

(7) In the event of the death of the sponsor, a short-term residence permit may be granted, without any period requirement, to those staying with a family residence permit dependent on that person.

MADDE 34 · Aile ikamet izni

(1) Türk vatandaşlarının, 5901 sayılı Kanunun 28 inci maddesi kapsamında olanların veya ikamet izinlerinden birine sahip olan yabancılar ile mültecilerin ve ikincil koruma statüsü sahiplerinin;

a) Yabancı eşine,

b) Kendisinin veya eşinin ergin olmayan yabancı çocuğuna,

c) Kendisinin veya eşinin bağımlı yabancı çocuğuna,

her defasında üç yılı aşmayacak şekilde aile ikamet izni verilebilir. Ancak, aile ikamet izninin süresi hiçbir şekilde destekleyicinin ikamet izni süresini aşamaz.

(2) Vatandaşı olduğu ülkenin hukukuna göre birden fazla eş ile evlilik hâlinde, eşlerden yalnızca birine aile ikamet izni verilir. Ancak, diğer eşlerinden olan çocuklara da aile ikamet izni verilebilir.

(3) Çocukların aile ikamet izninde, Türkiye dışında varsa ortak velayeti bulunan anne veya babanın muvafakati aranır.

(4) Aile ikamet izinleri, on sekiz yaşına kadar, öğrenci ikamet izni almadan ilk ve ortaöğretim kurumlarında eğitim hakkı sağlar.

(5) En az üç yıl aile ikamet izniyle Türkiye’de kalmış olanlardan on sekiz yaşını tamamlayanlar, talep etmeleri hâlinde bu izinlerini kısa dönem ikamet iznine dönüştürebilir.

(6) Boşanma hâlinde, Türk vatandaşıyla evli yabancıya, en az üç yıl aile ikamet izniyle kalmış olmak kaydıyla kısa dönem ikamet izni verilebilir. Ancak yabancı eşin, aile içi şiddet gerekçesiyle mağdur olduğu ilgili mahkeme kararıyla sabit ise, üç yıllık süre şartı aranmaz.

(7) Destekleyicinin ölümü hâlinde, bu kişiye bağlı aile ikamet izniyle kalanlara, süre şartı aranmadan kısa dönem ikamet izni verilebilir.
