Article 28: Interruption of residence

Part Two: Foreigners › Chapter Two: Residence

(1) In the implementation of the provisions of this Law, except for compulsory public service, education and health reasons, stays outside Türkiye exceeding a total of six months in one year or exceeding a total of one year within the last five years shall be deemed an interruption of residence. In the residence permit applications of persons whose residence has been interrupted, or in their transition to another residence permit, the previous permit periods shall not be taken into account.

(2) In calculating uninterrupted residence permit periods, half of the periods of student residence permits and the entirety of the periods of other residence permits shall be counted.

MADDE 28 · İkamette kesinti

(1) Bu Kanun hükümlerinin uygulanmasında; zorunlu kamu hizmeti, eğitim ve sağlık nedenleri hariç, bir yılda toplam altı ayı geçen veya son beş yıl içinde toplam bir yılı aşan Türkiye dışında kalışlar ikamette kesinti sayılır. İkamet süresinde kesintisi olanların ikamet izni başvurularında veya başka bir ikamet iznine geçişlerinde, önceki izin süreleri hesaba katılmaz.

(2) Kesintisiz ikamet izin sürelerinin hesaplanmasında, öğrenci ikamet izinlerinin yarısı, diğer ikamet izinlerinin ise tamamı sayılır.
