Article 36: Refusal, cancellation or non-extension of a family residence permit application

Part Two: Foreigners › Chapter Two: Residence

(1) In the following cases, a family residence permit shall not be granted, shall be cancelled if granted, and shall not be extended upon expiry:

a) Failure to meet, or the cessation of, the conditions required in paragraphs 1 and 3 of Article 35

b) Non-granting of a short-term residence permit after the conditions for obtaining a family residence permit have ceased to exist

c) Existence of a valid deportation decision or a ban on entry into Türkiye concerning the foreigner

ç) Determination that the family residence permit is being used for purposes other than those for which it was granted

(2) Added: 28/7/2016, Law No. 6735, Art. 27 The procedures and principles concerning the cancellation of the residence permit on account of the period spent abroad shall be regulated by regulation.

MADDE 36 · Aile ikamet izni talebinin reddi, iptali veya uzatılmaması

(1) Aşağıdaki hâllerde aile ikamet izni verilmez, verilmişse iptal edilir, süresi bitenler uzatılmaz:

a) 35 inci maddenin birinci ve üçüncü fıkralarında aranan şartların karşılanmaması veya ortadan kalkması

b) Aile ikamet izni alma şartları ortadan kalktıktan sonra kısa dönem ikamet izni verilmemesi

c) Hakkında geçerli sınır dışı etme veya Türkiye’ye giriş yasağı kararı bulunması

ç) Aile ikamet izninin, veriliş amacı dışında kullanıldığının belirlenmesi

(2) (Ek: 28/7/2016-6735/27 md.) İkamet izninin yurt dışında kalış süresi bakımından iptaline ilişkin usul ve esaslar yönetmelikle düzenlenir.
