Article 33: Refusal, cancellation or non-extension of a short-term residence permit

Part Two: Foreigners › Chapter Two: Residence

(1) In the following cases, a short-term residence permit shall not be granted, shall be cancelled if granted, and shall not be extended upon expiry:

a) Failure to fulfil, or the cessation of, one or more of the conditions required in Article 32

b) Determination that the residence permit is being used for purposes other than those for which it was granted

c) Repealed: 28/7/2016, Law No. 6735, Art. 27

ç) Existence of a valid deportation decision or a ban on entry into Türkiye concerning the foreigner

(2) Added: 28/7/2016, Law No. 6735, Art. 27 The procedures and principles concerning the cancellation of the residence permit on account of the period spent abroad shall be regulated by regulation.

MADDE 33 · Kısa dönem ikamet izninin reddi, iptali veya uzatılmaması

(1) Aşağıdaki hâllerde kısa dönem ikamet izni verilmez, verilmişse iptal edilir, süresi bitenler uzatılmaz:

a) 32 nci maddede aranan şartlardan birinin veya birkaçının yerine getirilmemesi veya ortadan kalkması

b) İkamet izninin, veriliş amacı dışında kullanıldığının belirlenmesi

ç) Hakkında geçerli sınır dışı etme veya Türkiye’ye giriş yasağı kararı bulunması

(2) (Ek: 28/7/2016-6735/27 md.) İkamet izninin yurt dışında kalış süresi bakımından iptaline ilişkin usul ve esaslar yönetmelikle düzenlenir.
