Article 31: Short-term residence permit

Part Two: Foreigners › Chapter Two: Residence

(1) A short-term residence permit may be granted to the following foreigners:

a) Those who will come for the purpose of scientific research

b) Those who own immovable property in Türkiye

c) Those who will establish business connections or a business

ç) Those who will participate in in-service training programmes

d) Those who will come for education or similar purposes within the framework of agreements to which the Republic of Türkiye is a party or student exchange programmes

e) Those who will stay for tourism purposes

f) Those who will receive medical treatment, provided that they do not carry any of the diseases deemed a threat to public health

g) Those who are required to stay in Türkiye upon the request or decision of judicial or administrative authorities

ğ) Those who transfer from a family residence permit to a short-term residence permit

h) Those who will attend Turkish language courses

ı) Those who will participate in education, research, internships and courses in Türkiye through public institutions

i) Those who have completed their higher education in Türkiye and apply within six months from the date of graduation

j) Added: 28/7/2016, Law No. 6735, Art. 27 Those who do not work in Türkiye but will make an investment within the scope and in the amount to be determined by the President of the Republic, as well as their foreign spouse and their own and their spouse's minor or dependent foreign children

(2) Amended: 28/7/2016, Law No. 6735, Art. 27 Except for subparagraphs (j) and (k) of paragraph 1, a short-term residence permit may be granted for periods of at most two years at a time.

(3) Residence permits granted under subparagraph (h) of paragraph 1 may be granted at most twice.

(4) Residence permits granted under subparagraph (i) of paragraph 1 may be granted only once, for a period of at most one year.

(5) Added: 28/7/2016, Law No. 6735, Art. 27 Residence permits granted under subparagraphs (j) and (k) of paragraph 1 may be granted for periods of at most five years each.

(6) Added: 21/11/2024, Law No. 7533, Art. 35 The nature and value of the immovable property on the basis of which a short-term residence permit is to be granted shall be determined by the Ministry.

(7) Added: 21/11/2024, Law No. 7533, Art. 35 In applications filed with the court by the foreigner or his or her legal representative or lawyer against decisions refusing an application for a short-term residence permit or cancelling a short-term residence permit, the case file shall be deemed complete upon submission of the defence or upon expiry of the time limit for submitting the defence. Where service cannot be effected at the address indicated by the claimant, the period provided for in paragraph 3 of Article 26 of the Administrative Procedure Law No. 2577 dated 6/1/1982 shall be applied as two months. Holding a hearing shall be at the discretion of the court.

MADDE 31 · Kısa dönem ikamet izni

(1) Aşağıda belirtilen yabancılara kısa dönem ikamet izni verilebilir:

a) Bilimsel araştırma amacıyla gelecekler

b) Türkiye’de taşınmaz malı bulunanlar

c) Ticari bağlantı veya iş kuracaklar

ç) Hizmet içi eğitim programlarına katılacaklar

d) Türkiye Cumhuriyeti’nin taraf olduğu anlaşmalar ya da öğrenci değişim programları çerçevesinde eğitim veya benzeri amaçlarla gelecekler

e) Turizm amaçlı kalacaklar

f) Kamu sağlığına tehdit olarak nitelendirilen hastalıklardan birini taşımamak kaydıyla tedavi görecekler

g) Adli veya idari makamların talep veya kararına bağlı olarak Türkiye’de kalması gerekenler

ğ) Aile ikamet izninden kısa dönem ikamet iznine geçenler

h) Türkçe öğrenme kurslarına katılacaklar

ı) Kamu kurumları aracılığıyla Türkiye’de eğitim, araştırma, staj ve kurslara katılacaklar

i) Türkiye’de yükseköğrenimini tamamlayanlardan mezuniyet tarihinden itibaren altı ay içinde müracaat edenler

j) (Ek: 28/7/2016-6735/27 md.) Türkiye’de çalışmayan ancak Cumhurbaşkanınca belirlenecek kapsam ve tutarda yatırım yapacaklar ile bunların yabancı eşi, kendisinin ve eşinin ergin olmayan veya bağımlı yabancı çocuğu

k) (Ek: 28/7/2016-6735/27 md.) Kuzey Kıbrıs Türk Cumhuriyeti vatandaşları

(2) (Değişik: 28/7/2016-6735/27 md.) Kısa dönem ikamet izni, birinci fıkranın (j) ve (k) bentleri hariç olmak üzere, her defasında en fazla ikişer yıllık sürelerle verilebilir.

(3) Birinci fıkranın (h) bendi kapsamında verilen ikamet izinleri en fazla iki defa verilebilir.

(4) Birinci fıkranın (i) bendi kapsamında verilen ikamet izinleri, bir defaya mahsus olmak üzere en fazla bir yıl süreli verilebilir.

(5) (Ek: 28/7/2016-6735/27 md.) Birinci fıkranın (j) ve (k) bentleri kapsamında verilen ikamet izinleri en fazla beşer yıllık sürelerle verilebilir.

(6) (Ek:21/11/2024-7533/35 md.) Kısa dönem ikamet izni verilmesine esas olacak taşınmazın niteliği ve değeri Bakanlıkça belirlenir.

(7) (Ek:21/11/2024-7533/35 md.) Yabancı veya yasal temsilcisi ya da avukatı tarafından, kısa dönem ikamet izni başvurusunun reddi ya da kısa dönem ikamet izninin iptali kararlarına karşı, mahkemeye yapılan başvurularda savunmanın verilmesi veya savunma verme süresinin geçmesiyle dosya tekemmül etmiş sayılır. Davacının gösterdiği adrese tebligat yapılamaması halinde, 6/1/1982 tarihli ve 2577 sayılı İdari Yargılama Usulü Kanununun 26 ncı maddesinin üçüncü fıkrasında öngörülen süre iki ay olarak uygulanır. Duruşma yapılması mahkemenin takdirine bağlıdır.
