(1) A student residence permit shall be granted to foreigners who will pursue associate, undergraduate, master's or doctoral studies at a higher education institution in Türkiye.
(2) Foreigners who will receive primary or secondary education and whose care and expenses are undertaken by a natural or legal person may, with the consent of their parents or legal representatives, be granted a student residence permit for periods of one year each for the duration of their education, and such permit may be extended.
(3) A student residence permit shall not confer on the student's mother and father or other relatives any right to obtain a residence permit.
(4) If the duration of education is less than one year, the duration of the student residence permit may not exceed the duration of education.
(5) Added: 28/7/2016, Law No. 6735, Art. 27 Foreigners who come through public institutions and organisations to pursue education in Türkiye may be granted a residence permit for the duration of their education.

MADDE 38 · Öğrenci ikamet izni
(1) Türkiye’de bir yükseköğretim kurumunda ön lisans, lisans, yüksek lisans ya da doktora öğrenimi görecek yabancılara öğrenci ikamet izni verilir.
(2) Bakımı ve masrafları gerçek veya tüzel kişi tarafından üstlenilen ilk ve orta derecede öğrenim görecek yabancılara, velilerinin veya yasal temsilcilerinin muvafakatiyle öğrenimleri süresince birer yıllık sürelerle öğrenci ikamet izni verilebilir ve uzatılabilir.
(3) Öğrenci ikamet izni, öğrencinin anne ve babası ile diğer yakınlarına, ikamet izni alma konusunda hiçbir hak sağlamaz.
(4) Öğrenim süresi bir yıldan kısa ise öğrenci ikamet izni süresi öğrenim süresini aşamaz.
(5) (Ek: 28/7/2016-6735/27 md.) Kamu kurum ve kuruluşları aracılığıyla gelerek Türkiye’de öğrenim görecek yabancılara, öğrenim süresince ikamet izni verilebilir.
