Article 17: Effects of parentage

Part One: Private International Law › Chapter Two: Conflict-of-Laws Rules

(1) The effects of parentage are governed by the law under which the parentage was established. However, if the mother, the father and the child have a common national law, the effects of parentage are governed by that law, and failing that, by the law of their common habitual residence.

MADDE 17 · Soybağının hükümleri

(1) Soybağının hükümleri, soybağını kuran hukuka tâbidir. Ancak ana, baba ve çocuğun müşterek millî hukuku bulunuyorsa, soybağının hükümlerine o hukuk, bulunmadığı takdirde müşterek mutad mesken hukuku uygulanır.
