Article 80

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

When an attachment is carried out, it is mandatory, if so requested, to open locked and closed premises and to show all kinds of articles.

If necessary, these places shall be opened by force, and locks and all kinds of devices may be broken. In taking attached property by force, any force required by the circumstances may be resorted to.

If the debtor has attachable valuables on his person and does not deliver them voluntarily or conceals them on his person, force shall also be used against his person.

MADDE 80

Haciz tatbikında istendiği takdirde, kilitli ve kapalı mahallerin açılması ve her türlü eşyanın gösterilmesi mecburidir.

Gerekirse bu yerler zorla açtırılır, kilit ve her türlü tertipler kırılabilir. Haczolunan malların zorla alınmasında hal ve durumun gerektirdiği her türlü zora başvurulabilir.

Borçlunun üzerinde haczi kabil kıymetli mallar bulunduğu ve kendisi bunları rızasiyle teslim etmediği veya üzerinde sakladığı takdirde şahsına karşı da zor kullanılır.
