Article 79

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

The attachment of receivables not based on an instrument payable to bearer or transferable by endorsement, of rights of all kinds such as salaries, wages, rent and the like, and of movable property held by third parties which cannot be attached by actually drawing up a report, shall be effected by serving notice of the attachment on the natural and legal persons and institutions that are the debtor or the possessor or that are obliged to pay the receivables and rights. By the attachment notice to be served by the collection office, the third party shall be notified that henceforth he may pay his debt only to the collection office and that payment made to the public debtor shall not be valid, or that he may deliver the movable property in his hands only to the collection office and that the property must not be given to the public debtor, failing which he shall be obliged to pay to the collection office the payments made to the public debtor and the value of the property, and shall be notified of the provisions of paragraphs 3, 4 and 5 of this article. Attachment notices issued by collection offices may be served electronically instead of by post, by the creditor collection offices or through the creditor public administration, and such service may be responded to electronically. The Ministry of Finance is authorised to determine the procedures and principles regarding service to be effected electronically and the submission of responses electronically.

Attachment notices issued by collection offices may be served on the branches of banks where the rights and receivables of the public debtor may be found, directly or through the local collection office, and, for receivables above the amount to be determined by the Ministry of Finance, may also be served directly on the head offices of banks. If the attachment notice has also been served on the head office of the bank, the obligation to make a declaration covering all of its branches rests with the head office of the bank.

A third party on whom an attachment notice is served who claims that he owes no debt, or that the property is not in his hands, or that before service of the attachment the debt was paid or the property was consumed or perished without his fault, or that the receivable was delivered to the debtor or to the place ordered by him, shall notify the situation in writing to the collection office within seven days from the service of the attachment notice on him. If the third party does not object within the time limit, the property shall be deemed to be in his hands and the debt to be owed by him, and the provisions of this Law shall be applied to him.

If the objection period is missed for any reason, the third party shall bring an action for a negative declaration before the courts of general jurisdiction within one year from the service of the attachment notice and shall prove that, as of the date of service of the attachment notice, he was not indebted to the public debtor or the property was not in his hands. Where an action for a negative declaration is brought, the court may order the suspension of the proceedings against security of the kind listed in Article 10 of this Law. The security shall be given to the creditor collection office and shall be attached on the basis of the attachment warrant. Disputes arising between the parties concerning the security shall be resolved by the court that ordered the suspension of the proceedings. Against a third party who loses his action, denial compensation amounting to 10% of the amount in respect of which he was unsuccessful shall additionally be awarded.

In respect of a third party who brings an action against the payment order served on him under this Law and whose objection proves wholly or partially unjustified, the provision of paragraph 5 of Article 58 of this Law shall not apply if the action for a negative declaration is decided in his favour or the principal public debtor has paid in full the public receivable subject to proceedings.

If the third party objects to the creditor collection office within seven days upon the attachment notice, the creditor public administration may, within one year, by proving the contrary of the objection made by the third party in an action to be brought before the courts of general jurisdiction, request that the third party be punished under paragraph 1 of Article 338 of the Enforcement and Bankruptcy Law and that payment of the amount owed by him be ordered.

Where delivery of movable property in kind is not possible, its value shall be paid. The rights of recourse of third parties against the principal debtor under general provisions are reserved.

Hamiline yazılı olmayan veya cirosu kabil senede dayanmayan alacaklar ile maaş, ücret, kira vesaire gibi her türlü hakların ve fiilen tutanak düzenlemek suretiyle haczi kabil olmayan üçüncü şahıslardaki menkul malların haczi, borçlu veya zilyed olan veyahut alacak ve hakları ödemesi gereken gerçek ve tüzel kişilere, kurumlara haciz keyfiyetinin tebliği suretiyle yapılır. Tahsil dairesi tarafından tebliğ edilecek haciz bildirisi ile; bundan böyle borcunu ancak tahsil dairesine ödeyebileceği ve amme borçlusuna yapılacak ödemenin geçerli olmayacağı veya elinde bulundurduğu menkul malı ancak tahsil dairesine teslim edebileceği ve malın amme borçlusuna verilmemesi gerektiği, aksi takdirde amme borçlusuna yapılan ödemeler ile malın bedelini tahsil dairesine ödemek zorunda kalacağı ve bu maddenin üç, dört ve beşinci fıkra hükümleri üçüncü şahsa bildirilir. Tahsil dairelerince düzenlenen haciz bildirileri, alacaklı tahsil dairelerince ya da alacaklı amme idaresi vasıtasıyla, posta yerine elektronik ortamda tebliğ edilebilir ve bu tebligatlara elektronik ortamda cevap verilebilir. Elektronik ortamda yapılacak tebliğe ve cevapların elektronik ortamda verilebilmesine ilişkin usûl ve esasları belirlemeye Maliye Bakanlığı yetkilidir.

Tahsil dairelerince düzenlenen haciz bildirileri; amme borçlusunun hak ve alacaklarının bulunabileceği bankaların şubelerine doğrudan veya mahallindeki tahsil dairesi aracılığı ile tebliğ edileceği gibi Maliye Bakanlığınca belirlenecek tutarın üzerindeki alacaklar için doğrudan bankaların genel müdürlüklerine de tebliğ edilebilir. Haciz bildirisi bankanın genel müdürlüğüne de tebliğ edilmiş ise tüm şubelerini kapsayacak şekilde beyanda bulunma yükümlülüğü bankanın genel müdürlüğüne aittir.

Haciz bildirisi tebliğ edilen üçüncü şahıs; borcu olmadığı veya malın yedinde bulunmadığı veya haczin tebliğinden önce borcun ödendiği veya malın tüketildiği ya da kusuru olmaksızın telef olduğu veya alacak borçluya veya emrettiği yere verilmiş olduğu gibi bir iddiada ise durumu, haciz bildirisinin kendisine tebliğinden itibaren yedi gün içinde tahsil dairesine yazılı olarak bildirmek zorundadır. Üçüncü şahsın süresinde itiraz etmemesi halinde, mal elinde ve borç zimmetinde sayılır ve hakkında bu Kanun hükümleri tatbik olunur.

Herhangi bir nedenle itiraz süresinin geçirilmesi halinde üçüncü şahıs, haciz bildirisinin tebliğinden itibaren bir yıl içinde genel mahkemelerde menfi tespit davası açmak ve haciz bildirisinin tebliğ edildiği tarih itibarıyla amme borçlusuna borçlu olmadığını veya malın elinde bulunmadığını ispat etmek zorundadır. Menfi tespit davası açılması halinde mahkemece bu Kanunun 10 uncu maddesinde sayılan türden teminat karşılığında takip işlemlerinin durdurulmasına karar verilebilir. Teminat, alacaklı tahsil dairesine verilir ve haciz varakasına dayanılarak haczedilir. Taraflar arasında teminata ilişkin olarak çıkan anlaşmazlıklar, takip işlemlerinin durdurulması hakkında kararı veren mahkeme tarafından çözümlenir. Davasında haksız çıkan üçüncü şahıs aleyhine, haksız çıktığı tutarın % 10'u tutarında ayrıca inkâr tazminatına hükmedilir.

Bu Kanun uyarınca kendisine tebliğ edilen ödeme emrine karşı dava açıp itirazında kısmen veya tamamen haksız çıkan üçüncü şahıs hakkında, menfi tespit davasının lehine sonuçlanması veya asıl amme borçlusunun takip konusu amme alacağını tamamen ödemiş olması halinde, bu Kanunun 58 inci maddesinin beşinci fıkrası hükmü uygulanmaz.

Üçüncü şahıs, haciz bildirisi üzerine yedi gün içinde alacaklı tahsil dairesine itiraz ettiği takdirde, alacaklı amme idaresi bir yıl içinde, üçüncü şahsın yaptığı itirazın aksini genel mahkemelerde açacağı davada ispat ederek, üçüncü şahsın İcra ve İflas Kanununun 338 inci maddesinin birinci fıkrasına göre cezalandırılmasını ve borçlu bulunduğu tutarın ödenmesine hükmedilmesini isteyebilir.

Menkul malların aynen teslimi mümkün olmadığı takdirde değeri ödenir. Üçüncü şahısların genel hükümler gereğince asıl borçluya rücu hakları saklıdır.
