Article 77

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

Movable property of all kinds shall be attached by recording in the attachment report its kind and type, characteristics, marks, number and quantity, and estimated value.

Added paragraph: 16/6/2009, Law No. 5904, Art. 24 The attachment of movable property recorded in an official register shall also be effected by notification to the office keeping the register for entry in the register. Attachment notices issued by collection offices may be served electronically instead of by post, by the creditor collection offices or through the creditor public administration, and such service may be responded to electronically. The Ministry of Finance is authorised to determine the procedures and principles regarding service to be effected electronically and the submission of responses electronically.

MADDE 77

Her türlü menkul mallar cins ve nevileri, vasıfları, alametleri, sayı ve miktarları ve tahmin edilen değerleri haciz zaptında tesbit edilmek suretiyle haczolunur.

(Ek fıkra: 16/6/2009-5904/24 md.) Resmi sicile kayıtlı olan menkul malların haczi, sicillerine işlenmek üzere sicilin tutulduğu daireye tebliğ edilmek suretiyle de yapılır. Tahsil dairelerince düzenlenen haciz bildirileri, alacaklı tahsil dairelerince ya da alacaklı amme idaresi vasıtasıyla, posta yerine elektronik ortamda tebliğ edilebilir ve bu tebligata elektronik ortamda cevap verilebilir. Elektronik ortamda yapılacak tebliğe ve cevapların elektronik ortamda verilebilmesine ilişkin usul ve esasları belirlemeye Maliye Bakanlığı yetkilidir.
