Article 357: A. Definition

Part Two: Special Obligational Relationships › Chapter Four: Lease Contract › Division Three: Usufructuary Lease

A usufructuary lease is a contract whereby the lessor undertakes to grant the lessee, against consideration, the use of a productive thing or right and the gathering of its fruits.

A sharecropping lease is a usufructuary lease in which the rent is agreed as a certain proportion of the fruits to be gathered. If this proportion has not been agreed by contract, it shall be determined according to local custom.

MADDE 357 · A. Tanımı

Ürün kirası kiraya verenin, kiracıya, ürün veren bir şeyin veya hakkın kullanılmasını ve ürünlerin devşirilmesini bedel karşılığında bırakmayı üstlendiği sözleşmedir.

Ürüne katılmalı kira, kira bedelinin devşirilecek ürünün belli bir oranı olarak kararlaştırıldığı ürün kirasıdır. Bu oran sözleşmeyle kararlaştırılmamışsa, yerel âdete göre belirlenir.
