Article 350: a. Need, reconstruction and redevelopment

Part Two: Special Obligational Relationships › Chapter Four: Lease Contract › Division Two: Leases of Residential Premises and Roofed Business Premises

The lessor may terminate the lease contract, by an action to be brought within one month starting from the date to be determined:

1. If there is a necessity to use the leased property owing to a need for a residence or business premises for himself or herself, his or her spouse, descendants, ascendants or other persons whom he or she is obliged by law to maintain,

2. If the substantial repair, extension or alteration of the leased property is necessary for the purpose of its reconstruction or redevelopment and the use of the leased property is impossible during such works,

in fixed-term contracts, at the end of the term, and in contracts of indefinite term, by complying with the termination period and the time limits provided for notice of termination under the general provisions on leases.

MADDE 350 · a. Gereksinim, yeniden inşa ve imar

Kiraya veren, kira sözleşmesini;

1. Kiralananı kendisi, eşi, altsoyu, üstsoyu veya kanun gereği bakmakla yükümlü olduğu diğer kişiler için konut ya da işyeri gereksinimi sebebiyle kullanma zorunluluğu varsa,

2. Kiralananın yeniden inşası veya imarı amacıyla esaslı onarımı, genişletilmesi ya da değiştirilmesi gerekli ve bu işler sırasında kiralananın kullanımı imkânsız ise,

belirli süreli sözleşmelerde sürenin sonunda, belirsiz süreli sözleşmelerde kiraya ilişkin genel hükümlere göre fesih dönemine ve fesih bildirimi için öngörülen sürelere uyularak belirlenecek tarihten başlayarak bir ay içinde açacağı dava ile sona erdirebilir.
