Article 504: I. Scope of the mandate

Part Two: Special Obligational Relationships › Chapter Nine: Mandate Relationships › Division One: Contract of Mandate

If the scope of the mandate is not expressly specified in the contract, it shall be determined according to the nature of the business to be conducted.

The mandate shall, in particular, also include the authority to carry out the legal transactions necessary for conducting the business undertaken by the agent.

Unless specially authorised, the agent may not bring an action, settle, resort to arbitration, request bankruptcy, postponement of bankruptcy or composition with creditors (konkordato), assume obligations under bills of exchange, make donations, stand as surety, transfer immovable property or encumber it with a right.

MADDE 504 · I. Vekâletin kapsamı

Vekâletin kapsamı, sözleşmede açıkça gösterilmemişse, görülecek işin niteliğine göre belirlenir.

Vekâlet, özellikle vekilin üstlendiği işin görülmesi için gerekli hukuki işlemlerin yapılması yetkisini de kapsar.

Vekil, özel olarak yetkili kılınmadıkça dava açamaz, sulh olamaz, hakeme başvuramaz, iflas, iflasın ertelenmesi ve konkordato talep edemez, kambiyo taahhüdünde bulunamaz, bağışlama yapamaz, kefil olamaz, taşınmazı devredemez ve bir hak ile sınırlandıramaz.
