Article 577: 2. Valuables

Part Two: Special Obligational Relationships › Chapter Fourteen: Contracts of Deposit A. General contract of deposit

Where valuables or a considerably large sum of money or securities have not been deposited with the operator for safekeeping, the operator shall be liable only in the event of fault on his part or on the part of his employees.

Where the operator has accepted such items for safekeeping or has refused to accept them, he shall be liable for the full value of the items.

With respect to belongings, money and similar things which the guest is expected to keep with him, the liability rule relating to his other belongings shall apply.

MADDE 577 · 2. Kıymetli eşya

Kıymetli eşya veya oldukça önemli miktarda para veya kıymetli evrak, işletene saklanması için bırakılmamışsa, işleten ancak kendisinin veya çalışanlarının kusuru hâlinde sorumlu olur.

İşleten, bunları saklamak üzere almış veya almaktan kaçınmışsa, eşyanın tam değerinden sorumludur.

Konaklayanın kendi yanında saklaması gereken eşya ile para ve benzeri şeyler hakkında, onun diğer eşyasına ilişkin sorumluluk kuralı uygulanır.
