Unless expressly authorised, the warehouse keeper may not commingle fungible goods of the same kind and quality.
Each depositor may claim, in respect of such goods commingled on the basis of authorisation, a share proportionate to his or her entitlement.
In this case, the warehouse keeper may separate the share of each depositor without the depositors needing to be present together.

MADDE 573 · III. Bırakılan şeylerin karışması
Ardiyeci açıkça yetkili kılınmadıkça, aynı tür ve nitelikteki mislî şeyleri birbirine karıştıramaz.
Yetkiye dayanılarak karıştırılan bu gibi şeyler üzerinde, saklatanlardan her biri, hakkıyla orantılı bir pay isteyebilir.
Bu durumda ardiyeci, saklatanların birlikte hazır bulunmasına gerek olmaksızın saklatanlardan her birinin payını ayırabilir.
