Of the wages paid on time by employers to persons with intellectual or psychiatric disabilities who are employed in sheltered workplaces and whose integration into the labour market is difficult, the following portions:
a) for each disabled person working in sheltered workplaces, an amount equal to the monthly allowance paid pursuant to subparagraph (a) of paragraph 1 of Article 2 of Law No. 2022 of 1/7/1976 on the Granting of Monthly Allowances to Needy, Infirm and Destitute Turkish Citizens Who Have Reached the Age of 65,
b) for each disabled person working in sheltered workplaces established in the provinces within the scope of Article 2 of Law No. 5084 of 29/1/2004 on the Promotion of Investments and Employment and on Amendments to Certain Laws, an additional twenty percent of the amount determined under subparagraph (a),
c) in workplaces employing more disabled persons than the number they are required to employ under the relevant legislation in order to obtain sheltered workplace status, for each disabled person employed above the required number, an additional twenty percent of the amount determined under subparagraph (a),
shall be paid by the Treasury to the employer, provided that the statutory obligations relating to these wages have also been fully and timely fulfilled.
The procedures and principles for the payment of the portions of wages specified in the first paragraph shall be determined by a regulation issued by the Ministry of Family and Social Policies upon obtaining the favourable opinion of the Ministry of Finance, the Ministry of Labour and Social Security and the Undersecretariat of Treasury.

EK MADDE 1 · Korumalı işyerlerinde çalışan engellilerin ücretleri

Korumalı işyerlerinde çalıştırılan ve iş gücü piyasasına kazandırılmaları güç olan zihinsel veya ruhsal engellilere işverenlerince zamanında ödenmiş olan ücretlerinin;
a) Korumalı işyerlerinde çalışan her engelli için 1/7/1976 tarihli ve 2022 sayılı 65 Yaşını Doldurmuş Muhtaç, Güçsüz ve Kimsesiz Türk Vatandaşlarına Aylık Bağlanması Hakkında Kanunun 2 nci maddesinin birinci fıkrasının (a) bendi gereğince ödenen aylık tutarı kadarı,
b) 29/1/2004 tarihli ve 5084 sayılı Yatırımların ve İstihdamın Teşviki ile Bazı Kanunlarda Değişiklik Yapılması Hakkında Kanunun 2 nci maddesi kapsamındaki illerde kurulmuş bulunan korumalı işyerlerinde çalışan her engelli için ilaveten (a) bendi ile belirlenen tutarın yüzde yirmisi,
c) Korumalı işyeri statüsü almak için ilgili mevzuatla çalıştırılması zorunlu olan sayıdan daha fazla engelli çalıştıran işyerlerinde, zorunlu sayının üstünde çalıştırılan her engelli için ilaveten (a) bendi ile belirlenen tutarın yüzde yirmisi,
bu ücretlere ilişkin yasal yükümlülüklerin de tam ve zamanında karşılanmış olması kaydıyla, Hazine tarafından işverene ödenir.
Birinci fıkrada belirlenen ücret kısımlarının ödenmesine ilişkin usul ve esaslar, Maliye Bakanlığı ile Çalışma ve Sosyal Güvenlik Bakanlığı ve Hazine Müsteşarlığının uygun görüşü alınmak suretiyle Aile ve Sosyal Politikalar Bakanlığı tarafından çıkarılan yönetmelikle belirlenir.
