If the amount specified in the preceding article is not obtained in the auction, the auction shall be extended for a further 7 days, provided that the commitment of the highest bidder remains in force. On the 7th day, at the same hour, the immovable property shall be awarded to the highest bidder. These matters shall be stated in the announcement made beforehand. However, where there is a creditor with priority, the award price must exceed the priority receivable together with the expenses; if it does not, the sale shall not take place.

Artırmada yukardaki maddede yazılı miktar elde edilmemiş ise, en çok artıranın taahhüdü baki kalmak şartiyle artırma 7 gün daha uzatılır. 7 nci günü aynı saatte gayrimenkul en çok artırana ihale edilir. Evvelce yapılan ilanda bu hususlar belirtilir. Şu kadar ki, ruçhanlı alacaklı bulunduğu takdirde ihale bedelinin ruçhanlı alacakla birlikte masrafları da aşması şarttır, aşmazsa satış yapılmaz.
