The buyer to whom the immovable property has been awarded by the sales commission acquires ownership of that immovable property. Rescission of the award may be requested by way of complaint to the enforcement review authority (icra tetkik mercii) of the place where the immovable property is located. The date of service of the award on the persons concerned shall be deemed the start of the 7-day period prescribed for complaint. The decision of the review authority may be appealed within 10 days. The appeal shall be examined by the Enforcement and Bankruptcy Chamber of the Court of Cassation. Where the value of the property awarded exceeds 50,000 New Turkish Liras, an oral hearing may be requested. No application may be made to any other court or to administrative judicial authorities concerning rescission of the award or rectification of the registration. The notification to be made to the land registry office for registration shall be made after the expiry of the period prescribed for complaint and, if a complaint has been made, after the complaint has been finally disposed of.

Satış komisyonu tarafından gayrimenkul kendisine ihale edilen alıcı o gayrimenkulün mülkiyetini iktisap etmiş olur. İhalenin feshi gayrimenkulün bulunduğu yerin icra tetkik merciinden şikayet yoliyle istenebilir. İhalenin ilgililere tebliği tarihi şikayet için muayyen olan 7 günlük müddete başlangıç sayılır. Tetkik merciinin vereceği karar 10 gün içinde temyiz olunabilir. Temyiz talebini Temyiz İcra ve İflas Dairesi tetkik eder. İhale edilen malın değeri 50.000 Yeni Türk Lirasını aştığı takdirde murafaa istenebilir. İhalenin feshi veya kaydın tashihi hakkında başkaca mahkemeye veya idari kaza mercilerine müracaat olunamaz. Tescil için tapu dairesine yapılacak tebligat şikayet için muayyen müddetin geçmesinden ve eğer şikayet edilmişse şikayetin intacından sonra yapılır.
