Article 102

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

A public receivable shall become time-barred if it is not collected within 5 years from the beginning of the calendar year following the calendar year in which it fell due. The provisions on limitation in the special laws relating to fines are reserved.

Payments voluntarily made by the taxpayer after the limitation period shall be accepted.

MADDE 102

Amme alacağı, vadesinin rasladığı takvim yılını takip eden takvim yılı başından itibaren 5 yıl içinde tahsil edilmezse zamanaşımına uğrar. Para cezalarına ait hususi kanunlarındaki zamanaşımı hükümleri mahfuzdur.

Zamanaşımından sonra mükellefin rızaen yapacağı ödemeler kabul olunur.
