Law No. 6183 on the Procedure for the Collection of Public Receivables

Article 103

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

The limitation period for collection shall be interrupted in the following cases:

1. Payment,

2. Execution of attachment,

3. Collections of every kind made as a result of compulsory collection and enforcement proceedings,

4. Service of a payment order,

5. Declaration of assets, and notification of acquisitions of assets and increases in assets,

6. The application of any of the procedures listed in the above 5 items to a guarantor or to the representatives of foreign persons and institutions, or the performance of such procedures by them,

7. The issuance of a reversal decision by judicial authorities in disputed public receivables,

8. The securing of the public receivable by a guarantee,

9. A decision by judicial authorities to stay enforcement,

10. A written application by the creditor public administration to the debtor public administration for payment of a debt existing between two public administrations.

11. Added: 25/12/2003, Law No. 5035, Art. 5 An application to pay the public receivable under special laws and/or the binding of the public receivable to a payment plan.

The limitation period shall begin to run anew from the beginning of the calendar year following the calendar year in which the interruption occurred. Where the limitation is interrupted by a reversal decision, the beginning of the limitation period shall be the first day of the calendar year following the calendar year in which the new due date falls; where the public receivable is secured by a guarantee or enforcement is stayed by judicial authorities, the beginning of the limitation period shall be the first day of the calendar year following the calendar year in which falls the date on which the guarantee is released or the period of the stay ends.

MADDE 103

Aşağıdaki hallerde tahsil zamanaşımı kesilir:

1. Ödeme,

2. Haciz tatbikı,

3. Cebren tahsil ve takip muameleleri sonucunda yapılan her çeşit tahsilat,

4. Ödeme emri tebliği,

5. Mal bildirimi, mal edinme ve mal artmalarının bildirilmesi,

6. Yukardaki 5 sırada gösterilen muamelelerden her hangi birinin kefile veya yabancı şahıs ve kurumlar mümessillerine tatbikı veya bunlar tarafından yapılması,

7. İhtilaflı amme alacaklarında kaza mercilerince bozma kararı verilmesi,

8. Amme alacağının teminata bağlanması,

9. Kaza mercilerince icranın tehirine karar verilmesi,

10. İki amme idaresi arasında mevcut bir borç için alacaklı amme idaresi tarafından borçlu amme idaresine borcun ödenmesi için yazı ile müracaat edilmesi.

11. (Ek: 25/12/2003-5035/5 md.) Amme alacağının özel kanunlara göre ödenmek üzere müracaatta bulunulması ve/veya ödeme planına bağlanması.

Kesilmenin rasladığı takvim yılını takip eden takvim yılı başından itibaren zamanaşımı yeniden işlemeye başlar. Zamanaşımının bir bozma karariyle kesilmesi halinde zamanaşımı başlangıcı yeni vade gününün rasladığı; amme alacağının teminata bağlanması veya icranın kaza mercilerince durdurulması hallerinde zamanaşımı başlangıcı teminatın kalktığı ve durma süresinin sona erdiği tarihin rasladığı; takvim yılını takip eden takvim yılının ilk günüdür.
