Where no bidder comes forward in the auctions, or the price offered does not exceed the priority receivable and the expenses as specified in Article 95, the attachment on the immovable property shall continue until the property is taken over (teferruğ) by the public administration.
If any bidder applies to the collection office during this period, then, provided that the application is deemed appropriate by the creditor public administration, a 7-day announcement for the sale shall be made and the immovable property shall be awarded to the highest bidder in accordance with the provisions of Article 95. If no bidder comes forward until the immovable property is taken over, the collection office may put the attached property up for sale at such times as it deems appropriate. In that case, the above provisions shall apply to the sale and the announcement, and the provisions of Article 95 shall apply to the award.

Artırmalarda istekli çıkmadığı veya teklif edilen bedel 95 inci maddede yazılı olduğu üzere ruçhanlı alacakla, masrafları aşmadığı takdirde amme idaresince teferruğ edilinceye kadar gayrimenkul üzerindeki haciz devam eder.
Bu müddette tahsil dairesine her hangi bir istekli müracaat ettiği takdirde, bu müracaat alacaklı amme idaresince uygun görülmek şartiyle, satış için 7 günlük bir ilan yapılarak gayrimenkul 95 inci madde hükümleri dairesinde en çok artırana ihale olunur. Gayrimenkul teferruğ edilinceye kadar bir istekli çıkmadığı takdirde tahsil dairesi mahcuz malı uygun gördüğü zamanlarda satışa çıkarabilir. Bu takdirde satış ve ilan hakkında yukardaki hükümler ve ihale için de 95 inci madde hükümleri tatbik olunur.
