Article 110

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

A debtor against whom enforcement proceedings have been initiated for the collection of a public receivable who, with the intent of preventing collection in whole or in part or of rendering collection more difficult, as to some or all of his or her property:

1. In actual fact, by disposing of it, destroying it or reducing its value,

2. Amended: 23/1/2008, Law No. 5728, Art. 162 Or in a manner contrary to the truth, by concealing it, smuggling it away, transferring it to another person by way of a simulated transaction, acknowledging debts that have no basis, or issuing receipts, destroys or diminishes its existence, shall, if the remaining property is insufficient to cover the debt, be punished with imprisonment from six months to three years.

MADDE 110

Amme alacağının tahsili için hakkında takip muamelelerine başlanan borçlu kısmen veya tamamen tahsile engel olmak veya tahsili zorlaştırmak maksadiyle mallarından bir kısmını veya tamamını:

1. Mülkünden çıkararak, telef ederek yahut değerden düşürerek gerçek surette,

2. (Değişik: 23/1/2008-5728/162 md.) Gizleyerek, kaçırarak muvazaa yolu ile başkasının uhdesine geçirerek veya aslı olmayan borçlar ikrar ederek, yahut alındılar vererek gerçeğe aykırı surette, varlığını yok eder veya azaltır ve geri kalan mallar borcu karşılamaya yetmezse altı aydan üç yıla kadar hapis cezası ile cezalandırılır.
