Provisional Article 4

Part One: General Principles › Chapter One: Scope of the Law, terms, officers charged and competent persons

The latest situation of those who had debts overdue as at 1/1/1962 in respect of income tax, corporate tax, domestic production tax, transport tax and banking and insurance transactions tax, whose requests for deferral made under Article 48 were rejected before the entry into force of this Law, and of those to whom the same Article has been applied (excluding State Economic Enterprises), shall be re-examined, on condition that they apply in writing to the collection office within one month from the date of entry into force of this Law.

As a result of this examination, the remaining debts of those found to be in difficult circumstances (where collection has been made, compulsorily or voluntarily, between 1/1/1962 and the date of entry into force of the Law in respect of debts falling within the scope of this Law, the amount to be deferred by instalments is the remaining balance of the debt) may be deferred by the Ministry of Finance, on a one-off basis, for an appropriate period by way of instalments, without being bound by the two-year restriction in Article 48 and in such a way as not to exceed the end of the 1962 budget year.

The provisions of the Law relating to requiring security, charging interest, attached property taking the place of security, substitution of security and supplementation of security that has lost its value are reserved.

The Ministry of Finance may delegate the deferral power granted by this Article, in part or in whole, to its local organisation.

The public receivable shall become due in cases of failure to comply with the conditions of deferral, or failure, upon written notification served by the collection office, to supplement the security or attached property that has lost its value, or to provide others in their place, within 15 days.

Gelir, Kurumlar, dahilde alınan istihsal, nakliyat ve banka ve sigorta muameleleri vergilerinden, 1/1/1962 tarihinde vadesi geçmiş borcu bulunanlardan 48 inci maddeye göre yaptıkları tecil talepleri bu Kanunun yürürlüğe girmesinden önce reddedilmiş olanlar ile haklarında aynı madde uygulanmış bulunanların (İktisadi Devlet Teşebbüsleri hariç) bu Kanunun yürürlük tarihinden itibaren bir ay içinde tahsil dairesine yazı ile müracaat etmeleri şartı ile; son durumları yeniden incelenir.

Bu inceleme sonunda, zor durumda bulundukları anlaşılanların, bakıye borçları (Bu Kanunun şümulüne giren borçlardan 1/1/1962 tarihi ile Kanunun yürürlük tarihi arasında cebren veya rızaen tahsilat yapılmış ise taksitlendirilmek suretiyle tecil edilecek miktar borç bakıyesidir.) Maliye Bakanlığınca, 48 inci maddedeki iki yıl kaydı ile bağlı olmaksızın; 1962 bütçe yılı sonunu tecavüz etmiyecek şekilde; taksitlendirilmek suretiyle münasip müddetle bir defaya mahsus olmak üzere tecil olunabilir.

Kanunun teminat istenmesi, faiz aranması, haczedilmiş malların teminat yerine geçmesi, teminatın değiştirilmesi ve değerini kaybeden teminatın tamamlanması ile ilgili hükümleri mahfuzdur.

Maliye Bakanlığı bu madde ile tanınan tecil yetkisini kısmen veya tamamen mahalli teşkilata devredebilir.

Tecil şartlarına riayet edilmemesi; tahsil dairesince yapılacak yazılı tebliğ üzerine 15 gün içinde değerini kaybeden teminatın veya mahcuz malların tamamlanmaması veya yerine başkalarının gösterilmemesi hallerinde amme alacağı muaccel olur.
