Additional Article 1: Discount for Early Payment

Where a public receivable is paid before the statutory payment period, the discount and principles set out below shall apply:

1. In early payments, the discount shall be applied at a monthly rate of 4% for each day from the payment date until the last day of the statutory payment period.

2. Amounts remaining at the end of the statutory payment period shall be deemed early payments and shall be processed in accordance with item (1) until they are set off against other public receivables. No discount shall be applied to cash refunds.

3. In calculating the periods to which the discount is to be applied, one month shall be taken as 30 days, and the day on which the payment is made shall not be taken into account.

4. The President of the Republic is authorised to reduce the rate set out in item (1) down to zero, to increase it up to 8%, and to determine different rates according to the type and maturities of public receivables.

5. The Ministry of Finance is authorised to limit the public receivables that will benefit from the provisions of this Article by their types and periods, to have it applied exclusively to public receivables that have been assessed, and to determine the manner and timing of the discount and other procedures and principles.

6. Added: 30/7/2003, Law No. 4962, Art. 4 In payments made without commission by using credit cards and similar cards pursuant to Article 41 of this Law, the payment date to be taken as the basis for applying the discount under this Article shall be the day on which the money is transferred to the account of the creditor collection office.

EK MADDE 1 · Erken Ödemede İndirim

Amme alacağının kanuni ödeme süresinden önce ödenmesinde, aşağıda belirtilen indirim ve esaslar uygulanır:

1. Erken ödemelerde indirim, ödeme tarihinden kanuni ödeme süresinin son gününe kadar, her gün için aylık % 4 oranında uygulanır.

2. Kanuni ödeme süresinin sonunda artakalan tutarlar, erken ödeme sayılır ve diğer amme alacaklarına mahsup edilinceye kadar (1) numaralı bende göre işlem yapılır. Nakden iadelerde indirim uygulanmaz.

3. İndirim uygulanacak sürelerin hesabında bir ay 30 gün olarak kabul edilir ve ödemenin yapıldığı gün dikkate alınmaz.

4. Cumhurbaşkanı; (1) numaralı bentte yazılı oranı sıfıra kadar indirmeye, % 8'e kadar artırmaya, amme alacaklarının nev'i ve vadeleri itibariyle farklı oranlar tespit etmeye yetkilidir.

5. Bu madde hükümlerinden yararlanacak amme alacaklarını nev'ileri ve dönemleri itibariyle sınırlamaya, münhasıran tahakkuk eden amme alacakları için uygulatmaya, indirimin yapılma şekli ve zamanı ile diğer usul ve esasları belirlemeye Maliye Bakanlığı yetkilidir.

6. (Ek: 30/7/2003-4962/4 md.) Bu Kanunun 41 inci maddesine göre kredi kartı ve benzeri kartlar kullanılmak suretiyle komisyonsuz yapılan ödemelerde, bu madde hükmüne göre indirim uygulamasına esas alınacak ödeme tarihi, paranın alacaklı tahsil dairesi hesabına geçtiği gündür.
