Article 823: I. In general

Book Four: LAW OF PROPERTY › Part Two: LIMITED RIGHTS IN REM › Chapter One: SERVITUDES AND LAND CHARGES › Division Two: USUFRUCT AND OTHER SERVITUDES A. Usufruct

A right of habitation confers the power to use a building or part of it as a dwelling.

A right of habitation may not be transferred to another person and does not pass to heirs.

Unless the Code provides otherwise, the provisions relating to usufruct shall also apply to the right of habitation.

MADDE 823 · I. Genel olarak

Oturma hakkı, bir binadan veya onun bir bölümünden konut olarak yararlanma yetkisi verir.

Oturma hakkı, başkasına devredilemez ve mirasçılara geçmez.

Kanunda aksine hüküm bulunmadıkça, intifa hakkına ilişkin hükümler oturma hakkına da uygulanır.
