Article 264: 1. Definition, form and content

A prepayment instalment sale is a sale in which the buyer undertakes to pay in advance, in parts, the sale price of a movable good, and the seller undertakes to transfer the thing sold to the buyer after the price has been paid in full.

A prepayment instalment sale contract shall not be valid unless made in writing. The following matters shall be specified in the contract:

1. The names and domiciles of the parties.

2. The subject matter of the sale.

3. The total sale price.

4. The number, amount and due dates of the instalments and the duration of the contract.

5. The bank authorised to accept the instalments.

6. The amount of interest undertaken towards the buyer.

7. The buyer's right to revoke, within seven days, the declaration of intent to conclude the contract.

8. The buyer's right to withdraw from the contract and the forfeit money payable by the buyer for that reason.

9. The place and date of conclusion of the contract.

MADDE 264 · 1. Tanımı, şekli ve içeriği

Ön ödemeli taksitle satış, alıcının taşınır bir malın satış bedelini önceden kısım kısım ödemeyi, satıcının da bedelin tamamen ödenmesinden sonra satılanı alıcıya devretmeyi üstlendikleri satıştır.

Ön ödemeli taksitle satış sözleşmesi, yazılı şekilde yapılmadıkça geçerli olmaz. Sözleşmede aşağıdaki hususlar belirtilir:

1. Tarafların adı ve yerleşim yeri.

2. Satışın konusu.

3. Toplam satış bedeli.

4. Taksitlerin sayısı, tutarı, vadesi ve sözleşmenin süresi.

5. Taksitleri kabule yetkili banka.

6. Alıcıya karşı üstlenilen faiz miktarı.

7. Alıcının yedi gün içinde sözleşme yapılması konusundaki irade açıklamasını geri alma hakkı.

8. Alıcının sözleşmeden cayma hakkı ve bu sebeple ödeyeceği cayma parası.

9. Sözleşmenin kurulduğu yer ve tarih.
