Article 582: I. Principal debt

Part Two: Special Obligational Relationships › Chapter Fifteen: Contract of Suretyship

A contract of suretyship may be concluded for an existing and valid debt. However, a contract of suretyship may also be concluded for a future or conditional debt, to take effect when that debt arises or the condition is fulfilled.

A person who gives a personal guarantee for a debt for which the debtor is not liable by reason of error or incapacity shall be liable in accordance with the statutory provisions on suretyship if, at the time of assuming the obligation, he knew of the defect vitiating the contract. The same rule shall also apply to a person who stands surety for a debt that has become time-barred with respect to the debtor.

Unless otherwise provided by law, the surety may not waive in advance the rights granted to him in this chapter.

MADDE 582 · I. Asıl borç

Kefalet sözleşmesi, mevcut ve geçerli bir borç için yapılabilir. Ancak, gelecekte doğacak veya koşula bağlı bir borç için de, bu borç doğduğunda veya koşul gerçekleştiğinde hüküm ifade etmek üzere kefalet sözleşmesi kurulabilir.

Yanılma veya ehliyetsizlik sebebiyle borçlunun sorumlu olmadığı bir borç için kişisel güvence veren kişi, yükümlülük altına girdiği sırada, sözleşmeyi sakatlayan eksikliği biliyorsa, kefaletle ilgili kanun hükümlerine göre sorumlu olur. Aynı kural, borçlu yönünden zamanaşımına uğramış bir borca kefil olan kişi hakkında da uygulanır.

Kanundan aksi anlaşılmadıkça kefil, bu bölümde kendisine tanınan haklardan önceden feragat edemez.
