The boundaries and coordinates of those immovables requiring implementation under this Article, among immovables which involve a diversity of issues and a multiplicity of parties and whose problems cannot be resolved through individual actions, such as parcels whose register and ground have become inconsistent over time because area, boundary or share corrections could not be made, parcels in which zoning implementation errors could not be corrected despite their existence having been established, parcels which have been subjected to informal division and whose registration could not be achieved, and/or parcels whose actual user and owner have diverged over time for various reasons, shall be determined by the President of the Republic upon the proposal of the Ministry.
In the determined areas, in carrying out all kinds of improvement, renewal, transformation, expropriation and similar implementations, to be served on the persons concerned, the Ministry shall be authorised: in the ex officio correction, on the basis of the correct amount, of share errors relating to ownership, of the surface area and boundary arrangements of parcels, and of distribution and area errors in areas that have undergone zoning implementation; in the identification and procurement of immovables acquired through expropriation, exchange and similar means, of immovables in the private ownership of the Treasury, or under the sovereignty and disposal of the State and capable of being subject to private ownership, or, where needed, of immovables outside the determined area that are in the private ownership of the Treasury, for the purpose of being evaluated within the scope of the implementations and used in expropriations to be carried out by way of exchange; in the conduct of the work and procedures relating to immovables that must be transferred and assigned to third parties and of transactions at the land registry; and in zoning plans of every scale and zoning implementations in the relevant areas, as well as in transfer to right holders and similar related procedures.
The procedures and principles concerning the implementation of this Article shall be determined by the Ministry.

Alan, sınır, hisse düzeltimi yapılamaması nedeniyle zamanla sicili ile zemini uyumsuz hâle gelen, imar uygulama hatalarının varlığı tespit edilmesine rağmen bu hataların düzeltilemediği, haricî bölünmeye tabi tutulup tescili sağlanamayan ve/veya zamanla farklı nedenlerle fiilî kullanıcısı ile maliki farklılaşmış parseller gibi konu çeşitliği ve taraf fazlalığı bulunan ve münferit davalar ile çözümü mümkün olmayan taşınmazlardan bu madde kapsamında uygulama yapılması gerekenlerin sınır ve koordinatları Bakanlığın teklifi üzerine Cumhurbaşkanınca belirlenir.
Belirlenen alanlarda; her türlü iyileştirme, yenileme, dönüşüm, kamulaştırma ve benzeri uygulamaların yapılmasında, ilgililere tebliğ edilmek üzere; mülkiyete ilişkin hisse hatalarının, parsellerin yüz ölçümü ve sınır düzenlemelerinin ve imar uygulaması gören alanlarda dağıtım ve alan hatalarının doğru miktar üzerinden resen düzeltilmesinde kamulaştırma, trampa ve benzeri yollarla edinilen taşınmazların, Hazinenin özel mülkiyetindeki veya özel mülkiyete konu olabilecek Devletin hüküm ve tasarrufu altındaki veya ihtiyaç duyulması hâlinde belirlenen alan dışında olup Hazinenin özel mülkiyetindeki taşınmazların uygulamalar kapsamında değerlendirilmek ve trampa yoluyla yapılacak kamulaştırmalarda kullanılmak üzere tespitinde ve temininde ve üçüncü kişilere devir ve temliki gereken taşınmazlarla ilgili iş ve işlemler ile tapudaki işlemlerin yürütülmesinde, ilgili alanlarda her tür ölçekteki imar planı ve imar uygulamaları ile hak sahibine devir ve benzeri ilgili işlemlerde Bakanlık yetkilidir.
Bu maddenin uygulanmasına ilişkin usul ve esaslar Bakanlıkça belirlenir.
