Those immovables which were registered in the land register as a common entrance before the entry into force of the Law and are actually used by the public as a road, but whose land register entries have not been deleted as roads, and which are reserved for public services and facilities in the zoning plan, shall be deleted from the land register in accordance with the allocation purpose in the zoning plan, without seeking consent, by decision of the municipal executive committee (belediye encümeni) within municipal and adjacent area boundaries, and by decision of the provincial administrative board outside them.

GEÇİCİ MADDE 4 · Müşterek giriş
Kanunun yürürlüğe girmesinden önce tapuda müşterek giriş olarak tescil edilip fiilen kamu tarafından yol olarak kullanılan tapu kaydı yol olarak terkin edilmeyen gayrimenkullerin imar planında kamu hizmet ve tesislerine ayrılanları belediye ve mücavir alan sınırları içinde belediye encümeni dışında ise il idare kurulu kararı ile muvafakat aranmaksızın imar planındaki tahsis amacına uygun olarak tapuda terkin edilir.
