Article 38: Occupation

Part Two: Various Misdemeanours

(1) A person who, without the express and written permission of the competent authorities, occupies squares, avenues, streets or pavements used by pedestrians, or offers goods for sale in such places, shall be imposed an administrative fine of fifty Turkish Lira by municipal police officers.

(2) A person who, without the express and written permission of the competent authorities, piles construction materials on squares, avenues, streets or pavements used by pedestrians shall be imposed an administrative fine of one hundred Turkish Lira up to five hundred Turkish Lira by municipal police officers.

(3) The provisions of special laws are reserved.

MADDE 38 · İşgal

(1) Yetkili makamların açık ve yazılı izni olmaksızın meydan, cadde, sokak veya yayaların gelip geçtiği kaldırımları işgal eden veya buralarda mal satışa arz eden kişiye, belediye zabıta görevlileri tarafından elli Türk Lirası idarî para cezası verilir.

(2) Yetkili makamların açık ve yazılı izni olmaksızın meydan, cadde, sokak veya yayaların gelip geçtiği kaldırımlar üzerine inşaat malzemesi yığan kişiye, belediye zabıta görevlileri tarafından yüz Türk Lirasından beşyüz Türk Lirasına kadar idarî para cezası verilir.

(3) Özel kanunlardaki hükümler saklıdır.
