Article 40: Failure to disclose identity

Part Two: Various Misdemeanours

(1) A person who, when asked in connection with the duty, refrains from giving information to a public official regarding his or her identity or address or makes a false statement shall be imposed an administrative fine of fifty Turkish Lira by that official.

(2) A person whose identity cannot be determined because he or she refrains from making a statement or makes a false statement shall be held, and the public prosecutor shall be informed of the situation immediately. This person shall be taken into custody until his or her identity is clearly established and, if necessary, placed in pre-trial detention. The provisions of the Code of Criminal Procedure shall apply as regards the competence and procedure for deciding on custody and pre-trial detention.

(3) Where the identity of the person is determined, custody or pre-trial detention imposed for this reason shall be terminated immediately.

MADDE 40 · Kimliği bildirmeme

(1) Görevle bağlantılı olarak sorulması halinde kamu görevlisine kimliği veya adresiyle ilgili bilgi vermekten kaçınan veya gerçeğe aykırı beyanda bulunan kişiye, bu görevli tarafından elli Türk Lirası idarî para cezası verilir.

(2) Açıklamada bulunmaktan kaçınması veya gerçeğe aykırı beyanda bulunması dolayısıyla kimliği belirlenemeyen kişi tutularak durumdan derhal Cumhuriyet savcısı haberdar edilir. Bu kişi, kimliği açık bir şekilde anlaşılıncaya kadar gözaltına alınır ve gerekirse tutuklanır. Gözaltına ve tutuklamaya karar verme yetkisi ve usulü bakımından Ceza Muhakemesi Kanunu hükümleri uygulanır.

(3) Kişinin kimliğinin belirlenmesi durumunda, bu nedenle gözaltına alınma veya tutuklanma haline derhal son verilir.
