Unless otherwise provided, a land charge under public law does not need to be registered in the land register.
Where the law grants the creditor only the power to request the establishment of a land charge, the land charge comes into existence only upon registration.

MADDE 841 · 2. Kamu hukukuna ilişkin taşınmaz yükü
Aksine hüküm yoksa, kamu hukukuna ilişkin taşınmaz yükünün tapu kütüğüne tescili gerekli değildir.
Kanunun alacaklıya yalnızca taşınmaz yükünün kurulmasını isteme yetkisini tanıdığı hâllerde taşınmaz yükü ancak tescille doğar.
