Article 836: VI. Maximum term

Book Four: LAW OF PROPERTY › Part Two: LIMITED RIGHTS IN REM › Chapter One: SERVITUDES AND LAND CHARGES › Division Two: USUFRUCT AND OTHER SERVITUDES A. Usufruct

A building right may be established as an independent right for a maximum of one hundred years.

After three quarters of its term have expired, a building right may at any time be extended for a new term of up to one hundred years, in compliance with the form prescribed for its establishment. Any prior undertaking in this respect is not binding.

Üst hakkı, bağımsız bir hak olarak en çok yüz yıl için kurulabilir.

Üst hakkı, süresinin dörtte üçü dolduktan sonra, kurulması için öngörülen şekle uyularak her zaman en çok yüz yıllık yeni bir süre için uzatılabilir. Bu konuda önceden yapılan taahhüt bağlayıcı değildir.
