Article 393: A. Definition

Part Two: Special Obligational Relationships › Chapter Six: Contracts of Service › Division One: General Contract of Service

A contract of service is a contract whereby the employee undertakes to perform work in dependence on the employer for a definite or indefinite period, and the employer undertakes to pay him or her wages according to time or to the work performed.

Contracts whereby the employee undertakes to regularly perform a service for the employer on a part-time basis are also contracts of service.

The provisions on the general contract of service shall also apply by analogy to apprenticeship contracts; the provisions of special laws are reserved.

MADDE 393 · A. Tanımı

Hizmet sözleşmesi, işçinin işverene bağımlı olarak belirli veya belirli olmayan süreyle işgörmeyi ve işverenin de ona zamana veya yapılan işe göre ücret ödemeyi üstlendiği sözleşmedir.

İşçinin işverene bir hizmeti kısmi süreli olarak düzenli biçimde yerine getirmeyi üstlendiği sözleşmeler de hizmet sözleşmesidir.

Genel hizmet sözleşmesine ilişkin hükümler, kıyas yoluyla çıraklık sözleşmesine de uygulanır; özel kanun hükümleri saklıdır.
