In buildings where it is obligatory to set aside a caretaker flat and a shelter, these units must meet the conditions and dimensions specified in the regulation.
Caretaker flats may be located within the main building, or may also be arranged anywhere in the garden or within outbuildings, provided that they are not built contrary to the rules and to technical and health requirements and do not exceed a gross area of 40 square metres.
Where space is set aside for the residence of service staff such as watchmen, gardeners and boiler attendants, the same conditions shall also be required for such spaces. The provisions of Articles 29 and 30 shall also apply to the units referred to in this Article.
Where and in which buildings a caretaker flat and a shelter must be set aside shall be indicated in the zoning regulations.

Kapıcı dairesi ve sığınak ayrılması mecburiyeti olan binalarda, bu dairelerin yönetmelikte belirtilen şart ve ölçüleri havi bulunması lazımdır.
Kapıcı daireleri anabina içinde olabileceği gibi, nizamlara, fen ve sağlık şartlarına aykırı yapılmamak, brüt 40 metrekareyi geçmemek şartı ile bahçenin herhangi bir yerinde veya müştemilat binaları içerisinde de tertiplenebilir.
Bekçi, bahçevan, kaloriferci gibi müstahdemin ikametine yer ayrılması halinde bu yerlerde de aynı şartlar aranır. 29 ve 30 uncu maddelerdeki hükümler bu maddede sözü geçen daireler hakkında da uygulanır.
Nerelerde ve hangi binalarda kapıcı dairesi ve sığınak ayrılması gerektiği imar yönetmeliklerinde gösterilir.
