Article 29

Chapter One: General Provisions

The period for commencing construction shall be two years from the date of the permit. Where construction is not commenced within this period, or where construction is commenced but, for whatever reason, is not completed within five years including the commencement period, the permit issued shall be deemed null and void. In this case, it shall be mandatory to obtain a new permit. Acquired rights in constructions already commenced are reserved.

No additional fee shall be collected upon renewal of the permit or amendment of the plan. However, in the event of an increase in the construction area or a change in the gross area or nature of the independent units, the amount of fee previously paid shall be deducted from the fee to be recalculated. Where there is a decrease in the amount of fee calculated under the new situation, no refund shall be made. Exemption provisions in other laws are reserved.

It shall be mandatory to keep the permit and its annexes at the construction site.

Yapıya başlama müddeti ruhsat tarihinden itibaren iki yıldır. Bu müddet zarfında yapıya başlanmadığı veya yapıya başlanıp da her ne sebeple olursa olsun, başlama müddetiyle birlikte beş yıl içinde bitirilmediği takdirde verilen ruhsat hükümsüz sayılır. Bu durumda yeniden ruhsat alınması mecburidir. Başlanmış inşaatlarda müktesep haklar saklıdır.

Ruhsat yenilenmesi ve plan tadili sırasında ayrıca harç alınmaz. Ancak inşaat sahasında artış, bağımsız bölümlerin brüt alanında veya niteliğinde değişme olması halinde yeniden hesaplanacak harçtan evvelce ödenen harç tutarı, tenzil edilir. Yeni durumda hesaplanan harç tutarında azalma olması halinde iade yapılmaz. Diğer kanunlardaki muafiyet hükümleri saklıdır.

Ruhsat ve eklerinin yapı yerinde bulundurulması mecburidir.
