In order to use a structure in its entirety where it has been fully completed, or to use those parts which can partially be used where they have been completed, it shall be mandatory to obtain permission from the municipality, governorship (...) offices which issued the construction permit; and, in order to use, in whole or in part, structures not subject to a permit under Article 27, from the relevant municipality and governorship. Upon the application of the owner, it must be determined that the structure conforms to the permit and its annexes and that there is no technical objection to its use.
Municipalities and governorships (...) shall be obliged to conclude the applications of owners within thirty days at the latest. Otherwise, at the end of this period, the use of the whole or of the completed part of the structure shall be deemed to have been permitted. (...)
The permission granted under this Article shall neither relieve the owner of the structure of liability arising from non-compliance with the law, the permit and its annexes, nor relieve him or her of the obligation to pay any taxes, duties and fees.

Yapı tamamen bittiği takdirde tamamının, kısmen kullanılması mümkün kısımları tamamlandığı takdirde bu kısımlarının kullanılabilmesi için inşaat ruhsatını veren belediye, valilik (...) bürolarından; 27 nci maddeye göre ruhsata tabi olmayan yapıların tamamen veya kısmen kullanılabilmesi için ise ilgili belediye ve valilikten izin alınması mecburidir. Mal sahibinin müracaatı üzerine, yapının ruhsat ve eklerine uygun olduğu ve kullanılmasında fen bakımından mahzur görülmediğinin tespiti gerekir.
Belediyeler, valilikler (...) mal sahiplerinin müracaatlarını en geç otuz gün içinde neticelendirmek mecburiyetindedir. Aksi halde bu müddetin sonunda yapının tamamının veya biten kısmının kullanılmasına izin verilmiş sayılır.(...)35
Bu maddeye göre verilen izin yapı sahibini kanuna, ruhsat ve eklerine riayetsizlikten doğacak mesuliyetten kurtarmayacağı gibi her türlü vergi, resim ve harç ödeme mükellefiyetinden de kurtarmaz.
