Article 431: Appointment of experts by the arbitrator or arbitral tribunal

Part Eleven: Arbitration

(1) The arbitrator or arbitral tribunal may decide on:

a) the appointment of one or more experts to report on matters it determines,

b) the parties' providing the expert with the necessary explanations and with the relevant documents and information,

c) the carrying out of an on-site inspection,

as the case may be.

(2) Unless otherwise agreed, upon the request of one of the parties or where the arbitrator or arbitral tribunal deems it necessary, the experts shall, after delivering their written or oral reports, attend a hearing to which they are summoned. At this hearing, the parties may put questions to the experts and may present private experts of their own choosing to testify on the points at issue.

MADDE 431 · Hakem veya hakem kurulunca bilirkişi seçimi

(1) Hakem veya hakem kurulu;

a) Belirlediği konular hakkında rapor vermek üzere bir veya birden çok bilirkişi seçimine,

b) Tarafların bilirkişiye gerekli açıklamaları yapmalarına, ilgili belge ve bilgileri vermelerine,

c) Keşif yapılmasına,

karar verebilir.

(2) Aksi kararlaştırılmadıkça, taraflardan birinin talebi veya hakem ya da hakem kurulunun gerekli görmesi üzerine bilirkişiler, yazılı veya sözlü raporlarını vermelerinden sonra çağrılacakları duruşmaya katılırlar. Bu duruşmada taraflar, bilirkişilere soru sorabilir ve uyuşmazlık konusunda kendi seçtikleri özel bilirkişileri dinletebilirler.
