In the registration of immovable property, the competent persons are: where the immovable belongs to the State, the most senior finance officer of the place where it is located; where it belongs to a special provincial administration, the governor; where it belongs to the pious foundations (evkaf), the director or officer of pious foundations; where it belongs to a municipality, the mayor; where it belongs to a village, the village headman (muhtar); and where it belongs to other legal persons established under a special law, their legal representatives. The provisions of the laws setting out the manner in which these representatives exercise their powers remain in force.

MADDE 1 · TAPU KANUNU
Gayrimenkullerin tescilinde o gayrimenkul Devlete ait ise bulunduğu yerdeki en büyük mal memuru, hususi idareye ait ise vali, evkafa ait ise evkaf müdürü veya memuru, belediyeye ait ise belediye reisi, köye ait ise muhtar ve mahsus kanunla teşekkül etmiş diğer hükmi şahıslara ait ise bunların kanuni mümessilleri salahiyetlidirler. Bu mümessillerin salahiyetlerini kullanma şeklini gösteren kanunlar hükmü yerinde durmaktadır.
