Article 6: Occupational health and safety services

Chapter Two: Duties, Powers and Obligations of the Employer and Employees

(1) For the provision of occupational health and safety services, which shall also cover activities aimed at the prevention of occupational risks and protection from such risks, the employer shall:

a) Assign from among its employees an occupational safety specialist, a workplace physician and, at workplaces in the very hazardous class with ten or more employees, other health personnel. Where there is no personnel having the determined qualifications among its employees, the employer may fulfil all or part of this service by obtaining services from joint health and safety units or ÇASMERs. However, where the employer has the determined qualifications and the necessary certificate, the employer may undertake the performance of this service itself, taking into account the hazard class and the number of employees. Added sentence: 10/9/2014, Law No. 6552, Art. 16 Employers or employer's representatives of workplaces in the less hazardous class with fewer than 50 employees who do not have the determined qualifications and the necessary certificate may carry out occupational health and safety services, except for pre-employment and periodic examinations and tests, provided that they complete the training announced by the Ministry.

b) Meet all necessary needs, such as tools, equipment, premises and time, of the persons it assigns or of the institutions and organisations from which it obtains services, so that they can perform their duties.

c) Ensure cooperation and coordination among those carrying out health and safety services at the workplace.

ç) Implement the measures which are in conformity with the occupational health and safety legislation and notified in writing by the persons it assigns or by the institutions and organisations from which it obtains services.

d) Inform the persons it assigns or the institutions and organisations from which it obtains services, employees coming from other workplaces to work at its workplace, and their employers, about matters known or likely to affect the health and safety of employees.

(2) Public institutions and organisations within the scope of the Public Procurement Law No. 4734 dated 4/1/2002 may obtain occupational health and safety services directly from revolving-fund organisations belonging to the Ministry of Health, or may obtain them within the framework of the provisions of Law No. 4734.

(3) At workplaces where a full-time workplace physician is assigned, the assignment of other health personnel is not mandatory.

(4) Added: 10/9/2014, Law No. 6552, Art. 16 In determining the duration of assignment to be made under subparagraph (a) of paragraph 1, apprentices and interns having student status within the scope of the Vocational Education Law No. 3308 dated 5/6/1986 and the Higher Education Law No. 2547 dated 4/11/1981 shall not be included in the total number of employees.

(5) Added: 9/1/2025, Law No. 7538, Art. 19 The procedures and principles concerning the application of this Article shall be determined by the Ministry.

MADDE 6 · İş sağlığı ve güvenliği hizmetleri

(1) Mesleki risklerin önlenmesi ve bu risklerden korunulmasına yönelik çalışmaları da kapsayacak, iş sağlığı ve güvenliği hizmetlerinin sunulması için işveren;

a) Çalışanları arasından iş güvenliği uzmanı, işyeri hekimi ve on ve daha fazla çalışanı olan çok tehlikeli sınıfta yer alan işyerlerinde diğer sağlık personeli görevlendirir. Çalışanları arasında belirlenen niteliklere sahip personel bulunmaması hâlinde, bu hizmetin tamamını veya bir kısmını ortak sağlık ve güvenlik birimlerinden veya ÇASMER’lerden hizmet alarak yerine getirebilir. Ancak belirlenen niteliklere ve gerekli belgeye sahip olması hâlinde, tehlike sınıfı ve çalışan sayısı dikkate alınarak, bu hizmetin yerine getirilmesini kendisi üstlenebilir. Belirlenen niteliklere ve gerekli belgeye sahip olmayan ancak 50’den az çalışanı bulunan ve az tehlikeli sınıfta yer alan işyeri işverenleri veya işveren vekili tarafından Bakanlıkça ilan edilen eğitimleri tamamlamak şartıyla işe giriş ve periyodik muayeneler ve tetkikler hariç iş sağlığı ve güvenliği hizmetlerini yürütebilirler.

b) Görevlendirdikleri kişi veya hizmet aldığı kurum ve kuruluşların görevlerini yerine getirmeleri amacıyla araç, gereç, mekân ve zaman gibi gerekli bütün ihtiyaçlarını karşılar.

c) İşyerinde sağlık ve güvenlik hizmetlerini yürütenler arasında iş birliği ve koordinasyonu sağlar.

ç) Görevlendirdikleri kişi veya hizmet aldığı kurum ve kuruluşlar tarafından iş sağlığı ve güvenliği ile ilgili mevzuata uygun olan ve yazılı olarak bildirilen tedbirleri yerine getirir.

d) Çalışanların sağlık ve güvenliğini etkilediği bilinen veya etkilemesi muhtemel konular hakkında; görevlendirdikleri kişi veya hizmet aldığı kurum ve kuruluşları, başka işyerlerinden çalışmak üzere kendi işyerine gelen çalışanları ve bunların işverenlerini bilgilendirir.

(2) 4/1/2002 tarihli ve 4734 sayılı Kamu İhale Kanunu kapsamındaki kamu kurum ve kuruluşları; iş sağlığı ve güvenliği hizmetlerini, Sağlık Bakanlığına ait döner sermayeli kuruluşlardan doğrudan alabileceği gibi 4734 sayılı Kanun hükümleri çerçevesinde de alabilir.

(3) Tam süreli işyeri hekimi görevlendirilen işyerlerinde, diğer sağlık personeli görevlendirilmesi zorunlu değildir.

(4) (Ek: 10/9/2014-6552/16 md.) Birinci fıkranın (a) bendine göre yapılacak görevlendirme süresinin belirlenmesinde 5/6/1986 tarihli ve 3308 sayılı Mesleki Eğitim Kanunu ile 4/11/1981 tarihli ve 2547 sayılı Yükseköğretim Kanunu kapsamındaki öğrenci statüsünde olan çırak ve stajyerler, çalışan sayısının toplamına dâhil edilmez.
