(1) Amended: 2/7/2012, Law No. 6352, Art. 98 In an investigation conducted in respect of an offence, where the grounds for pre-trial detention specified in Article 100 exist, it may be decided that the suspect be placed under judicial control instead of being detained.
(2) The provisions on judicial control may also be applied in cases where the Law provides for a prohibition of pre-trial detention.
(3) Judicial control involves subjecting the suspect to one or more of the obligations set out below:
a) Not leaving the country.
b) Reporting regularly to the places designated by the judge, within the periods specified.
c) Complying with the summonses of the authorities or persons specified by the judge and, where necessary, with control measures relating to his professional activities or to continuing his education.
d) Not driving any vehicles or certain of them and, where necessary, surrendering his driving licence to the court registry against a receipt.
e) Submitting to and accepting treatment or examination measures, including hospitalisation, in particular for the purpose of being cured of addiction to narcotic, stimulant or volatile substances or to alcohol.
f) Depositing a security, the amount of which and the time limits for its payment in a single instalment or in several instalments shall be determined by the judge upon the request of the public prosecutor, taking into account the financial situation of the suspect.
g) Not keeping or carrying weapons and, where necessary, surrendering the weapons owned to the judicial deposit office against a receipt.
h) Securing by a real or personal guarantee, in order to safeguard the rights of the victim of the offence, a sum of money whose amount and time limit for payment shall be determined by the judge upon the request of the public prosecutor.
i) Giving a guarantee that he will fulfil his family obligations and regularly pay the maintenance which he has been ordered to pay under judicial decisions.

(4) Added: 25/5/2005, Law No. 5353, Art. 14 Repealed: 2/7/2012, Law No. 6352, Art. 98 Re-enacted: 14/4/2020, Law No. 7242, Art. 15 It may be decided that a suspect who has been determined, pursuant to paragraph 3 of Article 16 of the Law on the Execution of Sentences and Security Measures No. 5275 dated 13/12/2004, to be unable to sustain his life alone under the conditions of a penal institution due to a serious illness or disability from which he suffers, and a female suspect who is pregnant or for whom six months have not elapsed since the date she gave birth, be placed under judicial control instead of being detained. Where a judgment of conviction has been rendered against the person and an appeal on points of fact and law (istinaf) or an appeal on points of law (temyiz) has been lodged in respect of that judgment, the court of first instance that rendered the judgment may also issue a judicial control decision by examining the UYAP records.
(5) In the implementation of the obligation specified in subparagraph (d), the judge or the public prosecutor may permanently or temporarily allow the suspect to drive a vehicle in the course of his professional activities.
(6) The period spent under judicial control shall not be deducted from the sentence on the ground that it constitutes a restriction of personal liberty. This provision shall not apply in the cases specified in subparagraphs (e) and (j) of paragraph 3 of this Article. MADDE 109 · Adlî kontrol
(1) (Değişik: 2/7/2012-6352/98 md.) Bir suç sebebiyle yürütülen soruşturmada, 100 üncü maddede belirtilen tutuklama sebeplerinin varlığı halinde, şüphelinin tutuklanması yerine adlî kontrol altına alınmasına karar verilebilir.
(2) Kanunda tutuklama yasağı öngörülen hallerde de, adlî kontrole ilişkin hükümler uygulanabilir.
(3) Adlî kontrol, şüphelinin aşağıda gösterilen bir veya birden fazla yükümlülüğe tabi tutulmasını içerir:
a) Yurt dışına çıkamamak.
b) Hâkim tarafından belirlenen yerlere, belirtilen süreler içinde düzenli olarak başvurmak.
c) Hâkimin belirttiği merci veya kişilerin çağrılarına ve gerektiğinde meslekî uğraşlarına ilişkin veya eğitime devam konularındaki kontrol tedbirlerine uymak.
d) Her türlü taşıtları veya bunlardan bazılarını kullanamamak ve gerektiğinde kaleme, makbuz karşılığında sürücü belgesini teslim etmek.
e) Özellikle uyuşturucu, uyarıcı veya uçucu maddeler ile alkol bağımlılığından arınmak amacıyla, hastaneye yatmak dahil, tedavi veya muayene tedbirlerine tâbi olmak ve bunları kabul etmek.
f) Şüphelinin parasal durumu göz önünde bulundurularak, miktarı ve bir defada veya birden çok taksitlerle ödeme süreleri, Cumhuriyet savcısının isteği üzerine hâkimce belirlenecek bir güvence miktarını yatırmak.
g) Silâh bulunduramamak veya taşıyamamak, gerektiğinde sahip olunan silâhları makbuz karşılığında adlî emanete teslim etmek.
h) Cumhuriyet savcısının istemi üzerine hâkim tarafından miktarı ve ödeme süresi belirlenecek parayı suç mağdurunun haklarını güvence altına almak üzere aynî veya kişisel güvenceye bağlamak.
i) Aile yükümlülüklerini yerine getireceğine ve adlî kararlar gereğince ödemeye mahkûm edildiği nafakayı düzenli olarak ödeyeceğine dair güvence vermek.

Maruz kaldığı ağır bir hastalık veya engellilik nedeniyle ceza infaz kurumu koşullarında hayatını yalnız idame ettiremediği 13/12/2004 tarihli ve 5275 sayılı Ceza ve Güvenlik Tedbirlerinin İnfazı Hakkında Kanunun 16 ncı maddesinin üçüncü fıkrası uyarınca tespit edilen şüpheli ile gebe olan veya doğurduğu tarihten itibaren altı ay geçmemiş bulunan kadın şüphelinin tutuklanması yerine adlî kontrol altına alınmasına karar verilebilir. Hakkında mahkûmiyet hükmü verilmiş ve bu hükümle ilgili olarak istinaf veya temyiz kanun yoluna başvurulmuş olması hâlinde, UYAP kayıtlarını incelemek suretiyle hükmü veren ilk derece mahkemesi de adlî kontrol kararı verebilir.
(5) Hâkim veya Cumhuriyet savcısı (d) bendinde belirtilen yükümlülüğün uygulamasında şüphelinin meslekî uğraşılarında araç kullanmasına sürekli veya geçici olarak izin verebilir.
(6) Adlî kontrol altında geçen süre, şahsî hürriyeti sınırlama sebebi sayılarak cezadan mahsup edilemez. Bu hüküm, maddenin üçüncü fıkrasının (e) ve (j) bentlerinde belirtilen hallerde uygulanmaz. (Ek cümle:8/7/2021-7331/15 md.) Ancak, (j) bendinde belirtilen konutunu terk etmemek yükümlülüğü altında geçen her iki gün, cezanın mahsubunda bir gün olarak dikkate alınır.
(7) (Ek: 6/12/2006 – 5560/19 md.) Kanunlarda öngörülen tutukluluk sürelerinin dolması nedeniyle salıverilenler hakkında adlî kontrole ilişkin hükümler uygulanabilir.
