Article 55: Cases deemed as worked for the purposes of annual leave

Chapter Three: Wages

The following periods shall be deemed worked in calculating the entitlement to annual paid leave:

a) Days on which the employee was unable to go to work due to an accident suffered or an illness contracted (However, any period exceeding the period provided for in sub-subparagraph (b) of subparagraph (I) of Article 25 shall not be counted.).

b) Days on which female employees are not made to work before and after childbirth pursuant to Article 74.

c) Days on which the employee was unable to go to work while assigned to manoeuvres or to duties under any law, other than active military service (Any part of this period exceeding 90 days per year shall not be counted.).

d) Fifteen days of the time the employee spent without working as a result of the work at the workplace where he or she is employed being suspended for more than one week without interruption due to compelling reasons (provided that the employee resumes work).

e) The periods referred to in Article 66.

f) Weekly rest days, national holidays and public holidays.

g) The half-day leave that must be granted, in addition to Sunday, to those working in X-ray examination rooms in accordance with the regulation issued on the basis of Law No. 3153.

h) Days on which employees were unable to attend work because they attended mediation meetings, sat on arbitration boards, performed the duties of employee representative on such boards, or attended, as employee or trade union representatives, councils, boards, commissions and meetings established under legislation relating to working life, or conferences, congresses or boards of international organisations concerned with labour matters.

j) Other leave granted by the employer and the short-time working periods under Article 65.

k) The annual paid leave periods granted to the employee as a result of the application of this Law.

MADDE 55 · Yıllık izin bakımından çalışılmış gibi sayılan haller

Aşağıdaki süreler yıllık ücretli izin hakkının hesabında çalışılmış gibi sayılır:

a) İşçinin uğradığı kaza veya tutulduğu hastalıktan ötürü işine gidemediği günler (Ancak, 25 inci maddenin (I) numaralı bendinin (b) alt bendinde öngörülen süreden fazlası sayılmaz.).

b) Kadın işçilerin 74 üncü madde gereğince doğumdan önce ve sonra çalıştırılmadıkları günler.

c) İşçinin muvazzaf askerlik hizmeti dışında manevra veya herhangi bir kanundan dolayı ödevlendirilmesi sırasında işine gidemediği günler (Bu sürenin yılda 90 günden fazlası sayılmaz.).

d) Çalışmakta olduğu işyerinde zorlayıcı sebepler yüzünden işin aralıksız bir haftadan çok tatil edilmesi sonucu olarak işçinin çalışmadan geçirdiği zamanın onbeş günü (işçinin yeniden işe başlaması şartıyla).

e) 66 ncı maddede sözü geçen zamanlar.

f) Hafta tatili, ulusal bayram, genel tatil günleri.

g) 3153 sayılı Kanuna dayanılarak çıkarılan yönetmeliğe göre röntgen muayenehanelerinde çalışanlara pazardan başka verilmesi gereken yarım günlük izinler.

h) İşçilerin arabuluculuk toplantılarına katılmaları, hakem kurullarında bulunmaları, bu kurullarda işçi temsilciliği görevlerini yapmaları, çalışma hayatı ile ilgili mevzuata göre kurulan meclis, kurul, komisyon ve toplantılara yahut işçilik konuları ile ilgili uluslararası kuruluşların konferans, kongre veya kurullarına işçi veya sendika temsilcisi olarak katılması sebebiyle işlerine devam edemedikleri günler.

ı) (Değişik: 4/4/2015-6645/35 md.) Ek 2 nci maddede sayılan izin süreleri,

j) İşveren tarafından verilen diğer izinler ile 65 inci maddedeki kısa çalışma süreleri.

k) Bu Kanunun uygulanması sonucu olarak işçiye verilmiş bulunan yıllık ücretli izin süresi.
