During mobilisation, and in workplaces meeting the requirements of national defence provided that this period is not exceeded, if overtime work is deemed necessary, the President of the Republic may increase the daily working time up to the employee's maximum working capacity, according to the type of work and the degree of need.
The provisions of the first, second and third paragraphs of Article 41 shall apply to the wages to be paid to employees made to work overtime in this manner.

MADDE 43 · Olağanüstü hallerde fazla çalışma
Seferberlik sırasında ve bu süreyi aşmamak şartıyla yurt savunmasının gereklerini karşılayan işyerlerinde fazla çalışmaya lüzum görülürse işlerin çeşidine ve ihtiyacın derecesine göre Cumhurbaşkanı günlük çalışma süresini, işçinin en çok çalışma gücüne çıkarabilir.
Bu suretle fazla çalıştırılan işçiler için verilecek ücret hakkında 41 inci maddenin birinci, ikinci ve üçüncü fıkraları hükümleri uygulanır.
