No provisions contrary to the rights granted to employees regarding the weekly rest day, national holidays and public holidays, to paid leave, or to the rights granted by this Law to employees working under the percentage system may be included in collective labour agreements or employment contracts.
Acquired rights arising from law, collective labour agreement, employment contract or custom that provide employees with more favourable rights and benefits in these matters are reserved.

MADDE 45 · Saklı haklar
Toplu iş sözleşmesi veya iş sözleşmelerine hafta tatili, ulusal bayram ve genel tatillerde işçilere tanınan haklara, ücretli izinlere ve yüzde usulü ile çalışan işçilerin bu Kanunla tanınan haklarına aykırı hükümler konulamaz.
Bu hususlarda işçilere daha elverişli hak ve menfaatler sağlayan kanun, toplu iş sözleşmesi, iş sözleşmesi veya gelenekten doğan kazanılmış haklar saklıdır.
