Article 49: Holiday wage according to the form of wage

Chapter Three: Wages

The employee's holiday wage is his or her wage per day, based on the days worked.

The holiday wage of employees working on a piece-rate, job-rate (akort), lump-sum or percentage basis shall be calculated by dividing the wage earned in the payment period by the days worked within the same period.

The holiday wage of employees working for an hourly wage is seven and a half times the hourly wage.

The provisions of the first paragraph of Articles 46, 47 and 48 shall not apply to monthly paid employees whose monthly salary is paid in full even when they are absent with an excuse due to illness, leave or other reasons. However, those among them who work on national holidays and public holidays shall additionally be paid one day's wage for each day worked.

MADDE 49 · Ücret şekillerine göre tatil ücreti

İşçinin tatil günü ücreti çalıştığı günlere göre bir güne düşen ücretidir.

Parça başına, akort, götürü veya yüzde usulü ile çalışan işçilerin tatil günü ücreti, ödeme döneminde kazandığı ücretin aynı süre içinde çalıştığı günlere bölünmesi suretiyle hesaplanır.

Saat ücreti ile çalışan işçilerin tatil günü ücreti saat ücretinin yedibuçuk katıdır.

Hasta, izinli veya sair sebeplerle mazeretli olduğu hallerde dahi aylığı tam olarak ödenen aylık ücretli işçilere 46, 47 ve 48 inci maddenin birinci fıkrası hükümleri uygulanmaz. Ancak bunlardan ulusal bayram ve genel tatil günlerinde çalışanlara ayrıca çalıştığı her gün için bir günlük ücreti ödenir.
