Article 39: Minimum wage

Chapter Three: Wages

In order to regulate the economic and social conditions of all kinds of employees working under an employment contract, whether or not they fall within the scope of this Law, the minimum limits of wages shall be determined by the Ministry of Labour and Social Security, through the Minimum Wage Determination Commission, at least once every two years.

The decisions of the Commission are final. The decisions shall enter into force upon publication in the Official Gazette.

The procedure for the meetings and work of the Commission, the principles to be applied in determining minimum wages and the attendance fees to be paid to the chair, members and rapporteurs shall be set out in a regulation to be prepared jointly by the Ministry of Finance and the Ministry of Labour and Social Security.

The secretariat services of the Minimum Wage Determination Commission shall be performed by the Ministry of Labour and Social Security.

MADDE 39 · Asgari ücret

İş sözleşmesi ile çalışan ve bu Kanunun kapsamında olan veya olmayan her türlü işçinin ekonomik ve sosyal durumlarının düzenlenmesi için Çalışma ve Sosyal Güvenlik Bakanlığınca Asgari Ücret Tespit Komisyonu aracılığı ile ücretlerin asgari sınırları en geç iki yılda bir belirlenir.

Komisyon kararları kesindir. Kararlar Resmi Gazetede yayımlanarak yürürlüğe girer.

Komisyonun toplanma ve çalışma şekli, asgari ücretlerin tespiti sırasında uygulanacak esaslar ile başkan, üye ve raportörlere verilecek huzur hakları Maliye Bakanlığı ve Çalışma ve Sosyal Güvenlik Bakanlığının birlikte hazırlayacakları yönetmelikte belirtilir.

Asgari Ücret Tespit Komisyonunun sekretarya hizmetleri, Çalışma ve Sosyal Güvenlik Bakanlığı tarafından yerine getirilir.
