Article 186: Trade in spoiled or altered food or medicines

Book Two: Special Provisions › Part Three: Offences Against Society › Chapter Three: Offences Against Public Health

(1) A person who sells, supplies or possesses any kind of things to be eaten or drunk, or medicines, which have been spoiled or altered in a manner endangering the life and health of persons, shall be given a penalty of imprisonment from one to five years and a judicial fine of up to one thousand five hundred days.

(2) Where this offence is committed within the scope of the practice of a profession or trade carried out on the basis of an official permit, the penalty to be imposed shall be increased by one third.

MADDE 186 · Bozulmuş veya değiştirilmiş gıda veya ilaçların ticareti

(1) Kişilerin hayatını ve sağlığını tehlikeye sokacak biçimde bozulmuş, değiştirilmiş her tür yenilecek veya içilecek şeyleri veya ilaçları satan, tedarik eden, bulunduran kimseye bir yıldan beş yıla kadar hapis ve binbeşyüz güne kadar adlî para cezası verilir.

(2) Bu suçun, resmi izne dayalı olarak yürütülen bir meslek ve sanatın icrası kapsamında işlenmesi halinde, verilecek ceza üçte bir oranında artırılır.
