Where the court orders the termination of the marriage by annulment or divorce or the transition to separation of property, agreements deviating from the statutory rules on participation in the surplus value shall be valid only if this is expressly provided for in the marital property agreement.

MADDE 238 · b. İptal, boşanma veya mahkeme kararıyla mal ayrılığında
Mahkemece evliliğin iptal veya boşanma sebebiyle sona erdirilmesine veya mal ayrılığına geçilmesine karar verilmesi hâllerinde, kanundaki artık değere katılmaya ilişkin düzenlemeden farklı anlaşmalar, ancak mal rejimi sözleşmesinde bunun açıkça öngörülmüş olması hâlinde geçerlidir.
