Article 50: Witnesses not to be sworn

Part Three: Testimony, Expert Examination and Inspection › Chapter One: Testimony

(1) The following persons shall be heard without oath:

a) Persons who have not completed the age of fifteen at the time of hearing.

b) Persons who, owing to lack of the capacity to discern, cannot comprehend the nature and significance of the oath.

c) Persons who are suspects, accused or convicted of participation in the offences that are the subject of the investigation or prosecution, or of favouring the offender in connection with these offences, or of destroying, concealing or altering evidence of the offence.

MADDE 50 · Yemin verilmeyen tanıklar

(1) Aşağıdaki kimseler yeminsiz dinlenir:

a) Dinlenme sırasında onbeş yaşını doldurmamış olanlar.

b) Ayırt etme gücüne sahip olmamaları nedeniyle yeminin niteliği ve önemini kavrayamayanlar.

c) Soruşturma veya kovuşturma konusu suçlara iştirakten veya bu suçlar nedeniyle suçluyu kayırmaktan ya da suç delillerini yok etme, gizleme veya değiştirmekten şüpheli, sanık veya hükümlü olanlar.
