Article 453: I. Area of activity

Part Two: Special Obligational Relationships › Chapter Six: Contracts of Service › Division Two: Commercial Traveller's Contract A. Definition and formation

If the commercial traveller has been authorised to operate in a specific marketing area or among a specific clientele and no written agreement to the contrary has been made, the employer may not authorise others to operate in the same area or clientele; however, he may himself conclude transactions with third parties.

If there is a reason requiring a change to the provision of the contract concerning the marketing area or clientele, the employer may change that provision unilaterally without observing the notice period, even if a notice period has been provided for in the contract; however, in that case the commercial traveller's right to compensation and to terminate the contract of service for just cause is reserved.

MADDE 453 · I. Faaliyet alanı

Pazarlamacıya belirli bir pazarlama alanında veya belirli bir müşteri çevresinde faaliyette bulunma yetkisi verilmiş ve aksine yazılı anlaşma da yapılmamışsa işveren, başkalarına aynı alan veya çevrede faaliyette bulunma yetkisi veremez; ancak, kendisi üçüncü kişilerle işlem yapabilir.

Sözleşmenin pazarlama alanı veya müşteri çevresine ilişkin hükmünün değiştirilmesini gerektiren bir sebep varsa işveren, söz konusu hükmü, sözleşmede fesih bildirim süresi öngörülmüş olsa bile, bu süreye uymadan tek taraflı olarak değiştirebilir; ancak, bu durumda pazarlamacının tazminat ve hizmet sözleşmesini haklı sebeple sona erdirme hakkı saklıdır.
